These terms and conditions set out the terms and conditions between the Customer (“you”, “your”) and Cynthia Corona (“us”, “we”), governing the use of our website and our downloadable digital file media and content, to include, but are not limited to downloadable PDF files, and e-books (the “Products”). Your use of our website, and purchase, download, and use of our products, constitutes your full acceptance of these terms and conditions. If you do not agree with these terms and conditions, you are to refrain from using our website or purchase, download, or use any of our products.
Due to the digital nature of this product, all sales are final. Our guide is a digital product and every sale is automatically sending a link to download the PDF. This product is non-refundable.
1. Agreements to our legal terms
These Legal Terms constitute a legally binding agreements between you, whether personally or on behalf of an entity ('you') and Cynthia Corona, concerning your access to and use of the Products. You agree that by accessing the Products, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes baby updating the ‘Last Updated’ date of these Legal Terms, and you waive any right to receive specific notice of such change.
2. Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights of the Product, including source code, databases, functionality, software, website designs, audio, videos etc, photographs, and graphics in the Product (collectively , the ‘Content’) as well as trademarks, service marks, and logos contained therein (the ’Marks’).
Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competitions laws) and treaties in the United States and around the world.
The Content and Marks are provided in or through the Product ‘AS IS’ for your personal, non commercial use or internal business purpose only.
The products, whether modified or not, and all intellectual property and copyright contained therein, are and shall at all times remain our sole and exclusive property. You agree that under no circumstances, whether the product has been modified or not, shall you have or attempt to claim ownership of any intellectual property rights or copyright in the product. Product sold are copyrighted by Cynthia Corona and all credit for the Product be attributed appropriately.
In accordance with the foregoing license prohibitions, you may not: (i) resell, redistribute or share any copies of the Product in whole or in part for any reason; (ii) claim the Product as your own; (iii) sell our intellectual property or e-commerce platform, including, but not limited to, Etsy, Ebay, and/or online or e-commerce platforms specialising or trading in personalised products.
Violation of these restrictions results in immediate access termination without a refund. Post-termination, you must delete downloaded content and are barred from future programs. We retain the right to pursue monetary compensation, punitive damages, and legal fees for violations involving copyright, trademark, or intellectual property.
3. Refund Policy
Due to the digital nature of this product, all sales are final. Upon purchase, you acknowledge the product's "as is" nature and forfeit cancellation or refund rights due to its electronic format. No exchanges or substitutions are allowed. You commit to refraining from initiating chargebacks via your payment provider. Payments for our products are irreversible, and we retain the right to adjust prices periodically.
4. Term and Termination:
You agree that Cynthia Corona, at our discretion, reserves the right to terminate your account for any reason, especially if there's a belief that you've violated the Terms and Conditions or engaged in fraudulent, illegal, or abusive activities. Such actions will be reported and referred to the relevant law enforcement authorities.
5. Modifications and interruptions
We reserve the right to change, modify, or remove the contents of the Product at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Product. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Product.
We can’t guarantee the Product will be available at all times, We may experience hardware, software, or other problems or need to perform maintenance related to the Product, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Product at any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience cause by your inability to access or use the Product during any downtime or discontinuance of the Product. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Product or to supply any corrections, updated, or releases in connection therewith.
6. Governing Law
These Legal Terms shall be governed by and defined following the laws of United Mexican States. Cynthia Corona and yourself irrevocably consent that the court of United Mexican States shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.
7. Dispute Resolution
You agree to irrevocably submit all disputes related to these Legal Terms or the legal relationship established by these Legal Terms to the jurisdiction of the United Mexican States courts. Cynthia Corona shall also maintain the right to bring proceedings as to the substance of the matter in the courts of the country where you reside or, if these Legal Terms are entered into in the course of your trade or profession, the state of your principal place of business.
8. Limitations of Liability
In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from our use of the Product, even if we have been advised of the possibility of such damages. Not with standing anything to the contrary contain herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us.
